TERMS AND CONDITIONS OF USE

  • DEFINITION“Seller” means Bond Ceramics Ltd;

  • “Buyer” means the person whose name is on the Order;

  • “Contract” means the Order and Order confirmation (incorporating and special conditions)

  • “Goods” means the goods which the seller is to sell in accordance with these terms and conditions;

  • “Order” meands the Buyer’s order for the goods;

  • “Price” means the price at which the Seller has agreed to accept the Buyer’s order;

  • “Writing” includes, facsimile transmissions, letter and email.


  1. OUR CONTRACT

These Terms and Conditions regulate the supply of goods sold by Bond Ceramics Ltd of 1 School Close, Guildford, Surrey GU1 1QJ (Seller) to the customer (Buyer) named on the order form provided on the Bond Ceramics Ltd website.  These terms and conditions together with the completed order form constitute the entire and only agreement between Seller and Buyer in relation thereto.  The Seller’s acceptance of the Buyer’s order by delivery of the goods constitutes a legally binding contract between said parties on these terms and conditions.


  1. PRICE & PAYMENT

3.1            The price payable for the goods the Buyer orders is set out on the Seller’s website at the time the Buyer places an order.  Plus any charges for carriage as set out in the order form.

3.2           All Goods are offered for sale subject to availability and subject to the Seller’s acceptance of the order.

3.3           The Seller must receive payment for the whole of the price of the goods the Buyer orders and any applicable charges for carriage, before the order can be accepted – unless the Seller has agreed otherwise in advance in writing.  Payments must be made in pounds sterling.

3.4           All prices on the Seller’s website are subject to VAT charges on the sale of goods.


  1. DELIVERY & TITLE

4.1        The Seller will deliver the goods in accordance with the Buyer’s order.  Goods paid for through the website can be supplied to UK addresses only.  A valid signature will be required on collection or delivery.  Immediately prior to despatch of the goods to the Buyer, title in the goods will pass to the Buyer.  In the unlikely event that the Buyer has not received all the goods within 21 days of the date of delivery (or where a delayed despatch within 21 days of the requested despatch date has been requested by the Buyer) the Buyer must notify us immediately.

4.2       If the Buyer fails to take delivery of the Goods then, in addition to any other right or remedy available to the Seller, the Seller may store the goods until actual delivery and charge the Buyer for the cost (including insurance) of storage, together with any other reasonable incidental costs. 


  1. AVAIALABILITY

While the Seller endeavours to hold sufficient stock to meet all orders, if they have insufficient stock to supply or deliver the goods ordered and paid for by the Buyer, the seller will refund you the price paid for such goods as soon as possible and in any case within 30 days, or in the case of an account customer, we may, in our absolute discretion, as soon as possible raise a credit to offset the amount invoiced to you.


  1. CANCELLATION & RETURNS

6.1            You may cancel your order by giving us notice of cancellation within 30 days of the date of collection or delivery.  Such notice may be given by mailing, faxing or emailing to the number or address set out on the order form.  If you are cancelling because of any problems with the goods please notify us of the problem at the time of cancellation.  A 20% restocking fee may apply.

6.2           On cancellation you must return the goods to us at your own cost unless the goods are being returned because they are faulty, incorrect goods or because of an unsuitable substitution by us, in which case we will meet the cost of the return.  We ask that you allow us to select the carrier.

6.3           If the collection of the cancelled items is to be made by us a charge of £47 ex VAT per pallet will be incurred.  Alternatively if the items were originally delivered by our courier the collection costs would be as follows:  the original delivery charge plus an additional £18 ex VAT third party collection surcharge.  Upon receipt of the goods back into our warehouse in good order a refund shall be issued.  The amount will be refunded back onto the original charge card, direct to a bank account or by cheque where applicable – within 30 days.

6.4           Goods must not be returned to the Seller except by prior arrangement confirmed in writing by the Seller.


  1. LIABILITY

If you have notified us of a problem with the goods we will either make good any shortage or non-delivery, replace or repair any goods that are damaged or defective upon delivery; or refund the amount paid by you for the goods in question.  We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.  This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.


  1. TERMINATION

We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due; or if proceedings are commenced by or against you alleging bankruptcy or insolvency.  Upon termination you indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply you with goods.


  1. FORCE MAJEURE

We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to any goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).


  1. GENERAL

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected.  This contract shall be governed by and interpreted in accordance with English Law.


  1. DESIGN AND REPRODUCTION

Drawings, photographs, part numbers, layout and style are considered property.  Reproduction in whole, or in part, strictly prohibited without written permission.  Quantities and measurements are approximate.  Trademarks acknowledged.  Exact products may vary from that shown.  All products subject to availability.
